DMCA Notice & Takedown Policy
Happy Yame respects the intellectual property of artists, photographers and brands. If you believe that something on happyyame.com, including a product design or image, uses your copyrighted work without permission, you can ask us to remove it under the Digital Millennium Copyright Act (DMCA).
Sending a takedown notice
Email your notice to help@happyyame.com with “DMCA Notice” in the subject line. To let us act on it, the notice should contain:
- Your full name, mailing address, phone number and email address.
- A description of the copyrighted work you believe has been copied.
- The URL of each page or product on our site where the material appears.
- A statement that you have a good-faith belief the use is not permitted by the copyright owner, its agent or the law.
- A statement that the information in your notice is accurate and, under penalty of perjury, that you are the copyright owner or are allowed to act on the owner’s behalf.
- Your physical or electronic signature.
What happens next
When we receive a complete notice, we review it and, where appropriate, remove or disable the listed material promptly. If the material was based on content supplied by a customer, we let that customer know.
Counter-notice
If your material was removed and you believe this was a mistake or a misidentification, you may send a counter-notice to the same email address. Include your name and contact details, the material that was removed and where it appeared, a statement under penalty of perjury that you believe it was removed by mistake, your consent to the jurisdiction of the appropriate court, and your signature. We may restore the material unless the original complainant informs us that they have filed a court action.
Repeat infringement
We may refuse future orders or remove content from anyone who repeatedly submits material that infringes other people’s rights.
Misuse of this process
Please make sure your claim is accurate before sending it. Under the DMCA, knowingly false claims can carry legal liability.
